03. Refund Policy

Service Delivery

CoreAnchorLabs provides professional e-commerce engineering services, including custom platform development, API integration, and conversion optimization. Due to the digital nature of our services and the significant resources allocated to each project, our refund policy is structured as follows:

Project Milestones and Payments

All projects with CoreAnchorLabs are structured around clearly defined milestones with corresponding payment schedules. Payments are due upon the completion and acceptance of each milestone. By engaging our services, you agree to the milestone-based payment structure outlined in your project proposal or contract.

Refund Eligibility

Refunds from CoreAnchorLabs may be issued under the following circumstances:

  • Pre-Work Cancellation: If you cancel a project before any work has commenced, CoreAnchorLabs will provide a full refund of any advance payments received within 14 business days.
  • Milestone Cancellation: If you cancel a project after work has begun on a specific milestone but before that milestone is completed, CoreAnchorLabs will refund the portion of payment for work not yet performed, less any non-recoverable costs incurred.
  • Completed Milestones: Payments for completed and accepted milestones are non-refundable, as the deliverables have been provided and accepted by the client.
  • Service Failure: If CoreAnchorLabs fails to deliver the agreed-upon deliverables for a milestone within the specified timeframe (excluding delays caused by the client), a full refund for that milestone will be issued.

Refund Process

To request a refund, you must contact CoreAnchorLabs in writing at [email protected] within 30 days of the payment date. Refund requests will be reviewed within 5 business days, and approved refunds will be processed within 14 business days using the original payment method.

Non-Refundable Items

The following are not eligible for refunds from CoreAnchorLabs:

  • Third-party software licenses or subscriptions purchased on your behalf.
  • Domain name registrations or hosting fees already provisioned.
  • Work completed and accepted by you as meeting the agreed specifications.
  • Additional work requested beyond the original project scope (change requests).

Governing Law

This Refund Policy shall be governed by and construed in accordance with the laws of Spain and the European Union, including the Consumer Rights Directive 2011/83/EU. Any disputes arising from this policy shall be subject to the exclusive jurisdiction of the courts of Ourense, España.

04. Terms of Service

1. Acceptance of Terms

By accessing or using the services provided by CoreAnchorLabs, located at Lugar de Nacimiento: A Gudiña, Ourense — 32540, A Gudiña, Ourense, España, España ("the Company," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not access or use our services.

2. Definitions

  • "Client," "you," or "your": Any individual or entity that engages CoreAnchorLabs for services.
  • "Services": All professional services provided by CoreAnchorLabs, including but not limited to e-commerce development, API integration, conversion optimization, and related consulting.
  • "Deliverables": All work products, code, designs, documentation, and materials created by CoreAnchorLabs in the performance of the Services.
  • "Project": The specific scope of work agreed upon between CoreAnchorLabs and the Client.

3. Scope of Services

CoreAnchorLabs provides professional e-commerce engineering services as described in individual project proposals and statements of work. The specific scope, deliverables, timelines, and pricing for each Project will be detailed in a separate agreement between CoreAnchorLabs and the Client. Any work outside the agreed scope will be treated as a change request and may incur additional charges.

4. Client Obligations

The Client agrees to:

  • Provide timely access to all necessary systems, accounts, credentials, and materials required for the performance of the Services.
  • Designate a primary point of contact with decision-making authority for the Project.
  • Review and provide feedback on Deliverables within the timeframes specified in the Project agreement.
  • Make all payments in accordance with the payment schedule outlined in the Project agreement.
  • Ensure that all content and materials provided to CoreAnchorLabs do not infringe upon the intellectual property rights of any third party.

5. Payment Terms

All payments to CoreAnchorLabs are due according to the payment schedule specified in the Project agreement. Unless otherwise agreed:

  • A non-refundable deposit of 30-50% is required before work commences.
  • Remaining payments are tied to Project milestones as defined in the Project agreement.
  • Invoices are payable within 14 days of issuance.
  • Late payments may incur a charge of 1.5% per month on the outstanding balance.
  • All prices are exclusive of applicable taxes (VAT/IVA), which will be added where required by law.

6. Intellectual Property

Upon full payment for a Project, the Client receives ownership of all Deliverables created specifically for that Project. CoreAnchorLabs retains all rights to:

  • Pre-existing code, libraries, frameworks, and tools used in the development process ("CoreAnchorLabs Tools").
  • General knowledge, skills, experience, and techniques acquired during the performance of the Services.
  • Any reusable components, modules, or patterns developed during the Project that are not specific to the Client's business requirements.

CoreAnchorLabs grants the Client a perpetual, non-exclusive license to use any CoreAnchorLabs Tools incorporated into the Deliverables.

7. Confidentiality

Both parties agree to maintain the confidentiality of all proprietary or confidential information disclosed during the course of the Project. This obligation survives the termination of the Project for a period of 3 years. Confidential information includes but is not limited to: business strategies, financial data, customer lists, technical specifications, source code, and trade secrets.

8. Limitation of Liability

To the maximum extent permitted by applicable law, CoreAnchorLabs shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, arising out of or in connection with the Services, regardless of the theory of liability. CoreAnchorLabs' total aggregate liability for any claim arising out of or relating to the Services shall not exceed the total fees paid by the Client to CoreAnchorLabs for the specific Project giving rise to the claim.

9. Warranty

CoreAnchorLabs warrants that the Services will be performed in a professional and workmanlike manner, consistent with generally accepted industry standards. CoreAnchorLabs provides a 30-day warranty on all Deliverables from the date of final delivery, during which we will correct any defects in the Deliverables at no additional charge. This warranty does not cover issues arising from: modifications made by the Client or third parties, misuse or improper use of the Deliverables, or changes in third-party services or platforms beyond CoreAnchorLabs' control.

10. Termination

Either party may terminate a Project agreement under the following conditions:

  • For Convenience: Either party may terminate with 14 days' written notice. The Client will pay for all work completed up to the termination date.
  • For Cause: Either party may terminate immediately if the other party materially breaches any provision of the agreement and fails to cure such breach within 10 days of receiving written notice.
  • Non-Payment: CoreAnchorLabs may suspend or terminate Services if the Client fails to make payment within 7 days of the due date.

Upon termination, CoreAnchorLabs will deliver all completed work to the Client and the Client will pay for all work completed up to the termination date.

11. Force Majeure

Neither party shall be liable for any failure or delay in performance due to circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials. The affected party will provide prompt written notice and use commercially reasonable efforts to mitigate the effects of the force majeure event.

12. Data Protection

CoreAnchorLabs processes personal data in accordance with the General Data Protection Regulation (EU) 2016/679 and the Spanish Organic Law 3/2018 on the Protection of Personal Data. Both parties agree to comply with all applicable data protection laws and regulations in connection with the Services. Details of CoreAnchorLabs' data processing practices are outlined in our Privacy Policy.

13. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Spain and the European Union. Any dispute arising out of or relating to these Terms or the Services shall be subject to the exclusive jurisdiction of the courts of Ourense, España. The parties agree to attempt to resolve any dispute through informal negotiation before initiating formal proceedings.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid under applicable law, such unenforceability or invalidity shall not render these Terms unenforceable or invalid as a whole. Such provisions shall be modified to the minimum extent necessary to make them enforceable and valid, while preserving their original intent.

15. Amendments

CoreAnchorLabs reserves the right to modify these Terms at any time. Changes will be effective immediately upon posting on our website. Your continued use of our services after any changes constitutes acceptance of the new Terms. We encourage you to review these Terms periodically.
